Diplomatic facility, duty facility and customs duty exemption   Source:  Customs Act, 2064 (2007) Section 9       (1)Diplomatic facility or duty facility shall, on recommendation of the Ministry of Foreign Affairs, Government of Nepal, be accorded, as prescribed, to those bodies, officials or persons who are entitled to enjoy such diplomatic facility or duty facility under any bilateral or multilateral treaty or agreement to which Nepal is a party.   (2) The Government of Nepal may, from time to time and by notification in the Nepal Gazette, accord the diplomatic facility or duty facility to such goods to be imported by such persons or bodies as specified in that notification.   (3) The Government of Nepal may, from time to time and by notification in the Nepal Gazette, accord partial or full customs duty exemption to the goods specified in that notification.   (4) The Government of Nepal may accord partial or full customs duty exemption to the goods to be imported in the name of any project to be operated under foreign loan or grant assistance or in the name of the contractor of such project.   (5) The Government of Nepal may accord partial or full customs duty exemption to the fuel to be consumed during international flight, engine of aircraft, spare parts, machine, equipment thereof, food, liquors, beer and light drinks consumed in flight by an international air service company.   (6) The provisions for according the duty facility to any goods to be brought again into Nepal from any part of Nepal via any abroad route shall be as prescribed.   (7) The provisions for according the duty facility to any goods to be sent again to a foreign country from the foreign country via Nepal shall be as prescribed.

Baggage Rules

In exercise of the powers conferred by subsection 3 of section 9 of the Customs Act 2064, Government of Nepal has issued the notice on the ‘Baggage Rules’ regarding the customs duty applicable on the personal goods , accompanied or unaccompanied. If any passenger is found to be importing or exporting goods without declaring at the customs office, such goods shall be seized and action will be taken against the passenger as per the prevailing law.

Transaction between entity and beneficiary

Source: Income Tax Act, 2058 (2002), Section 56   (1) If a property is disposed through transfer of ownership over the property in any manner of distribution between an entity and its beneficiary or in any other manner subject to Section 45, it shall be as follows:-   (a) The transferor of the property shall be deemed to have received, from the disposal, an amount equal to the market value of the property immediately before the disposal, and   (b) The transferee of the property shall be deemed to have incurred cost in a sum equal to that mentioned in clause (a) in acquiring the property.   (2) If any liability is disposed through transfer of the liability between any entity and its beneficiary subject to Section 45, it shall be as follows:-   (a) The transferor of the liability shall be deemed to have incurred cost, in disposing the liability, in a sum equal to the market value of the liability immediately before the disposal, and   (c) The transferee of the liability shall be deemed to have received an amount equal to that mentioned in clause (a) in assuming the liability.   (3) If any entity distributes dividends except profits as dividends to any beneficiary, the amount of such dividends shall be included in computing the income of the entity. Money and Banking Nepal Rastra Bank   Information   Not to avail or provide loans in an unauthorized manner   Source: Banking Offence and Punishment Act, 2064, Section 7   While availing or providing  loans from a bank or financial institution, no one shall commit the following acts:   (a)Avail or provide loans by submitting a false, fake or unreal financial  statement  or  by creating artificial business.   (b)Avail or provide over loans by way of unnatural over valuation of   collateral  security.   (c)Avail or provide loans by way of unnaturally hiking the project cost based on false details.   (d)Avail or provide credit, facility or discounts beyond the authority obtained or limit sanctioned.   (e)Re avail or re provide loans from or by other Bank of Financial Institution without  having due release of the collateral security once provided to a Bank or Financial  Institution or in excess than the amount covered by the collateral security against  the same collateral security.   However, this restriction shall not be applicable in case of release of loans to be provided under consortium.   (f)Avail loans through an entity having established in the name of a person who, in fact, does not have financial capability to run the business or, who is a person under undue influence or extend loans knowing the said facts.   (g)Extend credit more than the requirement compared to the customer’s business transaction.   (h)Accept or provide any sort of undue benefit in return to granting credit facility.     Agriculture and Co-Operatives   Department of Animal Health Services   Information   Terms to be Followed While Constructing a Quarantine Spot   Source: Animal Health and Livestock Services Rules, 2056 (1999), Rule 5     (1) The terms to be followed and the criteria to be met while constructing a quarantine spot shall be as follows.   (a) The land area should be of at least 6,500 sq meters;   (b) At least 500 (five hundred) meters far from the animal husbandry area, animal firm, abattoir, animal market, and the places of movement of animals;   (c) Arrangement shall be made to prevent the contact of the animals kept inside the quarantine with the outside animals;   (d) Arrangement for separate places shall be made for the animals of different species and for animals that have been entered into at different times;   (e) Appropriate arrangement shall be made for drinking water, light, ventilation and sewerage for animals;   (f) Arrangement shall be made for next inside door, in addition to main door, for the entry and exit of animals;   (g) Arrangement shall be made for places for storage of feeds, water, fodder, hay etc;   (h) Arrangement of platform shall be made for unloading and loading of animals to and from the means of transport;   (i) The floor shall be constructed in such a way that it may be cleaned up disinfected and dried easily;   (j) Arrangement shall be made for separate and adequate places for keeping the animals, storing the products of animal origin and livestock product materials;   (k) Arrangement shall be made for keeping the materials required to be kept in colds store, if any,   (l) There shall be adequate place for disinfection and appropriate place for storage of chemicals and materials for that purpose; and   (m) Provisions shall be made for deputation of employees efficient in the concerned subjects.   (2) No works other than those relating to quarantine shall be carried out inside the quarantine spot.   Contact us For Following Tender and other related information:

  Industry /Commerce/Supplies   Company Registrar’s Office   Information   Power to refuse to register company   Source: Companies Act, 2063 (2006), Section 6   (1) The Office may refuse to register a company in any of the following circumstances:   (a) If the name of the proposed company in identical with the name by which a company in existence has been previously registered or so resembles the name of that company as it might cause misleading,   (b) If the name or objective of the proposed company is contrary to the prevailing law or appears to be improper or undesirable in view of public interest, morality, decency, etiquette etc. or reflects criminal motive ,   (c) If the name of the proposed company is identical with the name of a company of which registration has been cancelled pursuant to this Act or that of a company which has been insolvent under the prevailing law or so resembles such name as it might cause misleading and a period of five years shall not expired after such cancellation of registration or insolvency,   (d) If the requirements for the incorporation of a company under this Act are not fulfilled.   (2) If the office refuses to register company in any of the circumstances as referred to in Sub-section (1) it shall give a notice there of, accompanied by the reasons therefore, to the applicant no later than 15 days after the date of application made for the incorporation of company pursuant to Section 4.   (3) If the office refuses to register any company pursuant to Sub-section (1) or fails to give a notice pursuant to Sub-section (2), a person who is not satisfied may file a complaint in the court within fifteen days.   Contact us For Following Tender and other related information:

  Labor and Transport Management   Department of Foreign Employment   Information   Provisions relating to labor permission sticker   Source: Foreign Employment Act, 2064 (2007), Section19   (1) After receiving visas of  workers selected pursuant to Section 17 and before  sending such workers for foreign employment, the licensee shall make a submit ssion, accompanied by the following details, to the Department for labor permission sticker:-   (a) In the e vent that skill-oriented training is required for any work, a certificate of such training and a certificate of orientation training,   (b) Health certificate,   (c) Insurance certificate,   (d) Contract made between the licensee and the worker,   (e) Contract made between the employer institution and the worker,   (f) A receipt or bank voucher of amount paid by the worker to the licensee,   (g) Other matters as prescribed.   (2) If, in examining the details submitted pursuant to Sub-section (1), the details are found to be in conformity with the details submitted pursuant to Section 15, the Department shall affix the labor permission sticker on the passport of such worker.   (3) If the information provided pursuant to Sub-section (1) is found to be inconsistent with the details submitted pursuant to Section 15, the Department may prevent the licensee from sending workers for foreign employment, and the information, accompanied by the reason for such prevention, shall be given to the licensee.   Contact us For Following Tender and other related information:

  Housing and Physical Planning   Ministry of Housing and Physical Planning   Information   Procurement of public construction works from native construction entrepreneur and construction entrepreneur in joint venture   Source: Construction Business Act, 2055 (1999), Section 12   (1) Notwithstanding anything contained in the prevailing law, any public construction works mentioned in an international competitive bidding may be procured from the following construction entrepreneur in the following circumstances:   (a) despite that the total contract price quoted in the bidding by a construction entrepreneur wholly owned by a Nepalese citizen or by a construction entrepreneur licensed under joint venture with a foreign construction entrepreneur with at least fifty percent of share owned by the Nepalese citizen or by a construction entrepreneur making a joint venture agreement with a foreign construction entrepreneur with at least fifty percent of share owned by the Nepalese citizen is higher by a maximum of seven and half percent than the total contract price quoted in the bidding by a foreign construction entrepreneur, the entrepreneur making such bidding.   (b) despite that the total contract price quoted in the bidding by a construction entrepreneur licensed under joint venture with a foreign construction entrepreneur with at least twenty five percent of share owned by the Nepalese citizen or by a construction entrepreneur making a joint venture agreement with a foreign construction entrepreneur with at least twenty five percent of share owned by the Nepalese citizen is higher by a maximum of five percent than the total contract price quoted in the bidding by a foreign construction entrepreneur, the entrepreneur making such bidding.   (2) Any public construction works valued at a maximum of sixty million rupees shall be procured from a Nepalese construction entrepreneur   Information and Communication   Ministry of Information   Information   Updating and Publication of Information   Source: Right to Information Act, 2064 (2007),Section 5   (1) A Public Body shall keep its  information updated.   (2) A Public Body, as long as possible, shall update at least of twenty years old information from the commencement of this Act related to it in pursuant to Sub-Section (1).   (3) A Public Body shall enlist and publish its following information:   (a) structure and nature of Body,   (b) functions, duties, and powers of Body,   (c) number of employees and working details of Body,   (d) service to be rendered by the Body,   (e) branch and responsible officer of the service providing Body,   (f) fee and time limit required for service,   (g) decision making process and authority,   (h) authority to hear appeal against decision   (i) description of functions performed   (j) name and designation of Chief and Information Officer   (k) list of Acts, Rules, By Laws or Guidelines   (l) updated description of income, expenditures and financial transactions.   (m) other particulars as prescribed.   (4) Public Body shall have to update and publish the information in accordance with Sub-Section (3) within three months from the date of commencement of this Act and in every three months thereafter.       Tourism and Civil Aviation

    Insurance   Beema Samiti   Information   The Insurer Operating the Life Insurance and Non-Life Insurance shall Operate Insurance Business in the Form of Separate Organization   Source: Insurance Regulation, 2049 (1993), Rule 15 A   (1) The Insurer registered to operate the Life Insurance and Non-Life Insurance Business and has been operating the Life Insurance and Non-Life Insurance Business before thecommencement of this Rule shall operate Life Insurance and Non- Life InsuranceBusiness in the form of separate organizations from the date as specified by the Board.   (2) The Insurer operating the Life Insurance and Non-Life Insurance Business in the form of separate organizations pursuant to sub-rule (1) shall comply with the terms and conditions as follows :   (a) To manage to operate only one Insurance Business between the two Insurance Businesses being operated by amending in the Memorandum and Articles of Association and to establish another organization to operate the another Insurance Business under the prevailing law,   (b) To have separate management for the separate organization operating separate Insurance Business pursuant to Clause (a),   (c) To manage the collection of paid-up capital separately for each organization,   (d) To comply with the terms and conditions specified by the Board relating to the operation of the Life Insurance and Non-Life Insurance Business separately.   (3) The Insurer shall establish a separate Insurance fund in the name of an organization operating Life Insurance Business for the amount of Life Insurance and in the name of an organization operating Non-Life Insurance Business for the amount of Non-Life Insurance and shall deposit the amounts in the separate funds out of the amounts deposited in the Insurance fund pursuant to section 21 of the Act while operating the Life Insurance andNon-Life Insurance Business in the form of separate organizations pursuant to sub-rule (1) and (2).     Securities   Securities Board  of Nepal (SEBON)   Information   Securities Entrepreneurs May be Classified   Source: Securities Board of Nepal Regulations, 2064, Rule 33   The Board may classify the securities entrepreneurs and determine their level on the basis of the capital fund deployed for the securities business and the capital and infrastructure of concerned body corporate along with the function to the carried out by such organization, professional experience, academic qualification of the directors, chief executive and representatives and as to whether or not they have passed the trainings and examinations prescribed by the Board from time to time.         THE END   Contact us For Following Tender and other related information:
